Privacy Policy

At BandHealth, we take your privacy seriously. This Privacy Policy (the “Policy”) explains what personal information we collect about you while you are using the Platform provided by BandHealth, Inc. (“BandHealth”, “we,” or “us”). By using or accessing this online community (the “Platform”) in any manner, you acknowledge that you accept the practices and policies outlined in this Policy. We reserve the right to change, modify, add, or remove provisions of this Policy and any changes to this Policy will be posted here.

Remember that your use of the Platform is at all times subject to our Terms of Use, which incorporates this Policy. Any terms we use in this Policy that are not defined are defined in the Terms of Use.

WHAT KINDS OF INFORMATION DO WE COLLECT?

To provide our Platform, we must process information about you. The types of information we collect depends on how you use the Platform. Even if you do not register with or provide any personal information to the Platform, we may collect information about your use of the Platform. You can learn how to access and delete information we collect by contacting us directly at support@BandHealth.com.

Things you and others do and provide

Information and content you provide. We collect the content, communications, and other information you provide when you use the Platform, including when you sign up for an account, create or share content, and message or communicate with others. This can include information in or about the content you provide (like metadata), such as the location of a photo or the date a file was created. Our systems automatically process content and communications you and others provide to analyze context and what's in them for the purposes described below. 

If you register or update an existing account with the Platform, you are required to provide certain personal information, such as your name, address, telephone number, gender, email address, date of birth, location, and a username and password to access your account. You have the option to provide additional personal information, for example, to create an extended online profile. You are responsible for ensuring the accuracy of the personal information that you submit to the Platform.

If you do not wish us to use or disclose personal information that you provide as disclosed in this Policy, you should not create a BandHealth account, or if you already have a BandHealth account, you should deactivate your account.

Networks and connections. We collect information about the people, accounts, and groups you are connected to and how you interact with them on the Platform, such as people you communicate with the most or groups you are part of.

Your usage. We collect information about how you use the Platform, such as the types of content you view or engage with; the features you use; the actions you take; the people or organizations you interact with; and the time, frequency and duration of your activities. For example, we log when you're using and have last used the Platform, and what people, groups, updates, announcements, and other content you view on the Platform.

Things others do and information they provide about you. We also receive and analyze content, communications and information that other people provide when they use the Platform. This can include information about you, such as when others send a message to you.

Advertisements. We may allow another company to service advertisements on the Platform. That company may set “cookies” on your device. We will not share any individually identifiable personal information that you provide to us with such advertising company, and it will not have access to your personal profile. However, it is possible that such advertising company may, through your use of the Platform, develop its own separate profile of you. Any information collected or stored by the ad-service or cookies is subject to the terms and policies of that company. Notwithstanding the foregoing, and for the avoidance of doubt, when you join a group on the Platform, we share your personal profile with the organization affiliated with the group. You can view what organization is affiliated with the group by clicking on a group or reaching out to us at support@BandHealth.com.

Third Parties. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their Cookies on your device(s). Please note, because of our use of Cookies, the Platform do not support "Do Not Track" requests sent from a browser at this time.

Device Information. As described below, we collect information from and about the computers, phones, and other web-connected devices you use to access the Platform, and we combine this information across different devices you use. For example, we use information collected about your use of the Platform on your phone to better personalize the content or features you see when you use the Platform on another device, such as your laptop or tablet, or to measure whether you took an action in response to an ad we showed you on your phone on a different device.

Information we obtain from these devices includes:

  • Device attributes: Information such as the operating system, hardware and software versions, and browser type.

  • Network and connections: Information such as the name of your mobile operator or ISP, language, time zone, mobile phone number, and IP address.

  • Cookie data: Data from cookies stored on your device, including cookie IDs and settings.

  • Precise geolocation data: When enabled by you, we collect precise location information provided by your mobile device. We do so to provide you with more relevant content based on your location. You may disable the collection and use of your location data through your device settings.

HOW DO WE USE THIS INFORMATION?

We use the information we have as described below and to provide and support the Platform.  Here's how:

Provide, personalize, and improve the Platform.

We use the information we have to deliver the Platform, including to personalize features and content (including your timeline and suggested matches) and make suggestions for you (such as people, organizations, groups, or events you may be interested in) on the Platform. To create a personalized platform that is unique and relevant to you, we use your connections, preferences, interests, and activities based on the data we collect and learn from you and others (including any data with special protections you choose to provide); how you use and interact with the Platform; and the people, places, or things you're connected to and interested in on the Platform.

Location-related information. We use location-related information-such as your current location, where you live, the places you report going, and the businesses and people you're near-to provide, personalize and improve our Platform, for you and others. Location-related information can be based on things like IP addresses and information from your and others' use of our Platform (such as the events you attend).

Platform research and development. We use the information we have to develop, test, and improve our Platform.

Sponsored content. We use the information we have about you-including information about your interests, actions, and connections-to select and personalize the sponsored content that we show you.

Provide measurement, analytics, and other business services.

We use the information we have to help partners measure the effectiveness of their participation in the Platform and understand the types of people who connect with their organization by messages, updates, or events.

Promote safety, integrity and security. We use the information we have to: verify accounts and activity; combat harmful conduct; detect and prevent spam and other bad experiences; maintain the integrity of the Platform; and promote safety and security on the Platform. For example, we use data we have to investigate suspicious activity or violations of our terms or policies.

Communicate with you. We use the information we have to send you marketing communications, communicate with you about the Platform, as well as material on behalf of third parties with whom we have a business relationship. By third parties we mean, for example, entities such as health associations and advertisers that link to the Platform. The information we send you may contain advertising or requests either from us or a third party on whose behalf we would send the information. Clicking on links to third party websites or enabling connections with third parties may allow those third parties to collect or share information about you. We do not control these third-party websites and are not responsible for their privacy policies. We also use your information to respond to you when you contact us.

HOW IS THIS INFORMATION SHARED?

Your information is shared with others in the following ways:

Sharing on the Platform

People and accounts you share and communicate with. When you share and communicate using the Platform, you choose the audience for what you share. For example, when you post on the Platform, you select the audience for the post, such as a group, all of your friends, or the public.

When you create an account on the Platform, your profile becomes visible to other Platform users and your profile may be found by other users of the Platform. You can control how your profile and the data it contains are shared on the Platform by using the privacy settings available to you when you visit the Settings.

You should think carefully before posting any personal information in any public forum. Public information can be seen by anyone, on or off the Platform, including if they don't have an account. This includes any information you share with a public audience; information in your public profile on the Platform; and content you share on the Platform. You, other people using the Platform, and we can provide access to or send public information to anyone on or off our Platform, including in search results. Public information can also be seen, accessed, reshared or downloaded through third-party services such as search engines, APIs, and offline media such as TV, and by apps, websites and other services that integrate with the Platform.

Content others share or reshare about you. You should consider who you choose to share with, because people who can see your activity on the Platform can choose to share it with others on and off our Platform, including people and businesses outside the audience you shared with. For example, when you share an event or send a message to specific friends or organizations, they can download, screenshot, or reshare that content to others across or off our Platform.

New owner. If the ownership or control of all or part of BandHealth or its assets changes, we may transfer your information to the new owner.

Sharing with Third-Party Partners

We work with third-party partners who help us provide and improve the Platform or use the Platform to grow their organizations. We don't sell any of your information to anyone. We also impose restrictions on how our partners can use and disclose the data we provide. Here are the types of third parties we share information with:

Partners who use our analytics services. We provide aggregated statistics and insights that help organizations understand how people are engaging with their announcements, events, and other content on and off the Platform. For example, an organization’s profile may receive information about the number of people or accounts who viewed, reacted to, or commented on their announcements, as well as aggregate demographic and other information that helps them understand interactions with their account.

Organization partners. We may share your email address and profile information with the organizations (for example, non-profit organizations, home health organizations, post-acute care organizations, hospitals, rehab centers, and telemedicine providers) that sponsor BandHealth communities that you join.

Measurement partners. We may share information about you with companies that aggregate it to provide analytics and measurement reports to our partners.

Vendors and service providers. We may provide information and content to vendors and service providers who support our business, such as by providing technical infrastructure services, analyzing how our Platform is used, providing customer service, or conducting surveys.

Researchers and academics. We also provide information and content to research partners and academics to conduct research that advances scholarship and innovation that support our business or mission, and enhances discovery and innovation on topics of general social welfare, technological advancement, public interest, health and well-being.

Law enforcement or legal requests. We share information with law enforcement or in response to legal requests in the circumstances outlined below.

How can I manage or delete information about me?

We provide you with the ability to access, rectify, port and erase your data. Learn more in the Settings.

We store data until it is no longer necessary to provide our services or until your account is deleted, whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs.

When you delete your account, we delete things you have posted, such as your photos and announcements, and you won't be able to recover that information later. Information that others have shared about you isn't part of your account and won't be deleted.

How do we respond to legal requests or prevent harm?

We access, preserve and share your information with regulators, law enforcement or others:

In response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States when we have a good-faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.

When we have a good-faith belief it is necessary to: detect, prevent and address fraud, unauthorized use of the Platform, violations of our terms or policies, or other harmful or illegal activity; to protect ourselves (including our rights, property or BandHealth), you or others, including as part of investigations or regulatory inquiries; or to prevent death or imminent bodily harm. For example, if relevant, we provide information to and receive information from third-party partners about the reliability of your account to prevent fraud, abuse and other harmful activity on and off our Platform.

Information we receive about you can be accessed and preserved for an extended period when it is the subject of a legal request or obligation, governmental investigation, or investigations of possible violations of our terms or policies, or otherwise to prevent harm. We also retain information from accounts disabled for terms violations for at least a year to prevent repeat abuse or other term violations.

Data Security and Retention

We seek to protect your data from unauthorized access, use and disclosure using appropriate physical, technical, organizational, and administrative security measures based on the type of data and how we are processing that data. You should also help protect your data by appropriately selecting and protecting your password and/or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account. Although we work to protect the security of your account and other data that we hold in our records, please be aware that no method of transmitting data over the Internet or storing data is completely secure. We cannot guarantee the complete security of any data you share with us, and except as expressly required by law, we are not responsible for the theft, destruction, loss or inadvertent disclosure of your information or content.  

We retain your data for as long as you have an open account with us or as otherwise necessary to provide you with our Platform. In some cases, we retain data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally.

Children

We are committed to protecting the privacy of children. Our Platform is not designed or intended to attract children under the age of 18. We do not knowingly collect or solicit personal information from children under 18; if you are a child under 18, please do not attempt to register for or otherwise use the Platform or send us any personal information.You may use the Service only if you are at least eighteen (18) years old. You represent that you are at least eighteen (18) years of age and if you are under the age of eighteen (18), you may only use the Service under the supervision, or with the direct consent, of a parent or legal guardian who has agreed to any agreement you enter into while using the Service, including this Privacy Policy. We reserve the right to require you at any stage to provide proof of age, and, if applicable, approval of your use of the Service by your parent or legal guardian, so that we can verify that only eligible Users are using the Service. In the event that it comes to our knowledge that a person under the age of eighteen (18) is using the Service, and we have not received your parent’s or legal guardian’s consent, we reserve the right to prohibit and block such User from accessing the Service and will make all efforts to promptly delete any personal information.

California Resident Rights

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at support@BandHealth.com. Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services that you do not wish such operators to track certain of your online activities over time and across different websites. Our Platform does not support DO Not Track requests at this time. To find out more about “Do Not Track,” you can visit www.allaboutdnt.com

Nevada Resident Rights 

If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that information. You can exercise this right by contacting us at support@BandHealth.com with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your information as sales are defined in Nevada Revised Statutes Chapter 603A.

How will we notify you of changes to this policy?

We are constantly trying to improve our Platform, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice by either sending you an email or by some other means. Please note that if you've opted not to receive legal notice emails from us (or you haven't provided us with your email address), those legal notices will still govern your use of the Platform. You are still responsible for reading and understanding them. If you use the Platform after any changes to the Policy have been posted; such use indicates that you agree to all changes. Use of information we collect is subject to the Policy in effect at the time such information is collected.
